These Terms and Conditions (“Terms”) govern the access and use of the website operated under the brand “The Will Writing” (“Platform”, “we”, “us”, or “our”), including all services offered therein. By accessing or using the Platform and its services, the user (“you”, “your”, or “User”) unconditionally agrees to be bound by these Terms. If you do not accept these Terms, you are advised not to access or use any of the services provided through the Platform.
The Platform provides a range of legal support services including, but not limited to, will drafting, legal consultation, document registration, notarial services, and optional door-to-door documentation assistance (collectively referred to as the “Services”). These Services may be rendered either directly by us or through our network of licensed and affiliated law firms, legal professionals, and third-party service providers (hereinafter referred to as “Affiliated Firms”).
To access and use the Services, the User must be at least 18 years of age and possess the legal capacity to enter into a binding contract. The User also undertakes to provide accurate, complete, and updated information as required during the availing of Services. Any misrepresentation or false submission of data may lead to denial or termination of Services.
The User agrees to furnish true and correct information and to abstain from using the Platform for any unlawful, unauthorized, or fraudulent activity. The User shall not impersonate any person or entity and shall maintain the confidentiality of login credentials and associated accounts. It shall be the User’s obligation to cooperate with us or our partners during the process of service delivery, including but not limited to availability for document execution, verification, or attestation. The User acknowledges that the quality, accuracy, and enforceability of the will or other legal documents are contingent upon the integrity of the information provided.
We undertake to facilitate communication and coordination between the User and appropriate legal professionals or Affiliated Firms. We shall make commercially reasonable efforts to ensure timely delivery of Services, maintain confidentiality of the User’s data in accordance with our Privacy Policy, and extend support via available communication channels. However, we do not warrant or guarantee the accuracy or adequacy of legal advice provided by any third party, nor do we assume responsibility for ensuring jurisdiction-specific legal compliance of the documents unless expressly agreed upon.
Certain aspects of the Services may be executed by Affiliated Firms or licensed third-party legal professionals, under separate engagement directly between the User and such professionals. While we take reasonable steps to verify their credentials, we shall not be held liable for their acts, omissions, errors, or negligence. The User acknowledges that certain legal services, including notary, registration, or attestation, may be governed by specific legal formalities and are subject to the discretion and availability of concerned authorities or professionals.
All applicable fees for Services shall be clearly disclosed on the Platform prior to order confirmation. The User agrees to pay the fees in advance or in accordance with the mutually agreed payment terms. Prices are subject to revision at our sole discretion; however, such changes shall not affect confirmed and ongoing orders already accepted by us.
Refunds shall only be initiated in cases where Services are not rendered or have failed solely due to reasons attributable to us or our Affiliated Firms. No refund shall be issued once legal drafting, consultation, or processing of documents has commenced. Users may cancel their request before the commencement of Services, subject to deduction of any applicable administrative or processing fees. Where door-to-door services are cancelled after dispatch of personnel, additional charges may apply.
We reserve the right to suspend or permanently terminate the User’s access to the Platform or Services, with or without prior notice, under circumstances that include, but are not limited to: breach of these Terms, suspected fraudulent activity, direction by competent legal authority, or any conduct that, in our opinion, exposes us to legal, reputational, or operational risk. Users may discontinue use of the Services at any time; however, such termination shall not absolve them of liability for payment of any accrued charges.
All content displayed on the Platform, including but not limited to logos, service names, descriptions, text, graphics, and interface elements, are the intellectual property of The Will Writing or its licensors. No part of the Platform content shall be copied, reproduced, transmitted, or distributed in any manner whatsoever without our prior written consent.
The Platform and Services are provided on an “as-is” and “as available” basis. We make no express or implied warranties regarding the quality, suitability, or accuracy of the Services. To the fullest extent permitted by applicable law, we disclaim liability for any direct, indirect, incidental, special, or consequential losses or damages resulting from the use of, or inability to use, the Platform or Services. We shall not be liable for delays or non-performance arising from factors beyond our control, including but not limited to governmental action, courier or postal delays, or third-party failures.
The User agrees to indemnify, defend, and hold harmless The Will Writing, its proprietors, partners, Affiliated Firms, employees, agents, and representatives against any and all losses, damages, liabilities, claims, demands, or expenses (including legal costs) arising out of or in connection with the User’s breach of these Terms, use of the Platform, or violation of any third-party rights.
User data shall be collected, stored, and processed in accordance with our Privacy Policy. We are committed to protecting your personal information and ensuring compliance with applicable data protection legislation in India.
These Terms shall be governed and interpreted in accordance with the laws of the Republic of India. Any disputes or claims arising under or in connection with these Terms shall first be resolved through amicable negotiation. Failing resolution, such disputes shall be referred to arbitration in accordance with the provisions of the Arbitration and Conciliation Act, 1996. The arbitration proceedings shall be conducted by a sole arbitrator mutually appointed by the parties. The seat and venue of arbitration shall be Mumbai, India, and the language shall be English.
We reserve the right to amend, update, or modify these Terms at any time without prior notice. Any changes shall become effective immediately upon being published on the Platform. Continued usage of the Platform and its Services following any such changes shall constitute your consent to the revised Terms. We encourage you to review these Terms periodically.
